DMCA Policy & Takedown Procedure

ZwedGaming respects the intellectual property rights of others and expects its users to do the same. Our platform provides information and access related to mobile adaptations of games. In accordance with the Digital Millennium Copyright Act (DMCA), Title 17, United States Code, Section 512(c), we will respond expeditiously to claims of copyright infringement committed using the ZwedGaming service and/or the ZwedGaming website (the "Site") if such claims are reported according to the procedures outlined below.
Reporting Claims of Copyright Infringement
If you are a copyright owner, authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the Site by completing the following DMCA Notice of Alleged Infringement and delivering it to our Designated Copyright Agent as specified below.
Upon receipt of a valid Notice as described below, ZwedGaming will take whatever action, in its sole discretion, it deems appropriate, including removal of the challenged content from the Site.
DMCA Notice of Alleged Infringement ("Notice")
To ensure your claim is processed efficiently, please provide all of the following information. Incomplete notices may result in a delay or an inability to process your request.
To be effective, the Notice must be in writing and include substantially the following information (pursuant to 17 U.S.C. § 512(c)(3)):
- An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest;
- A description of the copyrighted work that you claim has been infringed;
- A description of where the material that you claim is infringing is located on the Site, with enough detail that we may find it on the Site (providing specific URLs is required);
- Your contact information, including address, telephone number, and email address;
- A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
- A statement by you, made under penalty of perjury, that the above information in your Notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.
How to Submit a Notice & Designated Copyright Agent
Please deliver your completed DMCA Notice of Alleged Infringement to our Designated Copyright Agent via email. Ensure your communication includes "DMCA Notice" in the subject line to facilitate prompt processing:
Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages.
Counter-Notice Procedure
If you believe that material you posted on the site was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with us (a "Counter-Notice") by submitting written notification to our Designated Copyright Agent (contact information provided above). Pursuant to the DMCA, the Counter-Notice must include substantially the following:
- Your physical or electronic signature.
- An identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access disabled.
- Adequate information by which we can contact you (including your name, postal address, telephone number, and, if available, email address).
- A statement under penalty of perjury by you that you have a good faith belief that the material identified above was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled.
- A statement that you will consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if you reside outside the United States for any judicial district in which the Website may be found) and that you will accept service from the person (or an agent of that person) who provided the Website with the complaint at issue.
Please ensure your communication includes "DMCA Counter-Notice" in the subject line.
Please note that we may forward the Counter-Notice, including your contact information, to the party who submitted the original Notice. If we do not receive notice within 10-14 business days that the original claimant is seeking a court order to prevent further infringement of the material at issue, we may replace or restore access to the material that was removed.
Repeat Infringer Policy
In accordance with the DMCA and other applicable law, ZwedGaming has adopted a policy of terminating, in appropriate circumstances and at ZwedGaming's sole discretion, users or contributors who are deemed to be repeat infringers. ZwedGaming may also at its sole discretion limit access to the Site and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
